Legal experts weigh in after New York appeals court keeps Trump’s gag order in place after guilty verdict

A New York appeals court on Tuesday kept in place a gag order on former President Trump, who asked the court to lift the ban on his speech after the recent guilty verdict in his unprecedented criminal trial.

Now that the trial has concluded and the former president and presumptive GOP nominee in the 2024 presidential election awaits sentencing next month, experts say the gag order, which Judge Juan Merhcan has refused to lift, is “untethered from any compelling rationale.”

“You have a local New York judge effectively limiting what the leading presidential candidate can say in the months leading up to an election,” Jonathan Turley, practicing defense attorney and law professor, told Fox News Digital.

“The continuation of the gag order seems untethered from any compelling rationale, particularly in light of the election,” he said.

Turley noted that appellate courts are generally “highly deferential” to courtroom management-type issues like the imposition and continuation of gag orders, but he said it is “deeply concerning that Judge Merchan would continue a gag order long after the verdict has been reached and the jury dismissed the case.”

“Putting aside the questionable value of the continuation of the gag order, in this case, Judge Merchan is ignoring the countervailing cost for the political system,” Turley added.

The New York Court of Appeals on Tuesday rejected Trump’s bid to have the gag order against him lifted, citing that “no substantial constitutional question is directly involved.”

Trump’s lawyers cited the November presidential election and the first debate against President Biden later this month, as well as the First Amendment rights of the former president and his supporters, as reasons for the order to be lifted.

The former president was found guilty on all 34 counts of falsifying business records in the first degree last week. The six-week trial stemmed from charges brought by Manhattan District Attorney Alvin Bragg. Trump will be sentenced on July 11, just days before the Republican National Convention.

Merchan imposed the gag order on Trump before the trial began, barring Trump from making or directing others to make public statements about witnesses with regard to their potential participation or about counsel in the case – other than Bragg – or about court staff, DA staff or family members of staff.

John Shu, a constitutional attorney who served in both Bush administrations, noted that some of New York’s highest-profile defendants were not subject to such a gag order as the 45th president.

“The Manhattan DA’s office has charged all kinds of high-profile criminal defendants throughout its history, ranging from celebrities to gangsters, such as Lucky Luciano, the head of La Commissione, and they weren’t silenced the way former President Trump was,” said Shu.

“Neither was John Gotti, the former head of the Gambino crime family and known as the ‘Teflon Don,’” he said, though that was a federal case.

“Say what you want about Donald Trump, but he’s not a mobster,” Shu added.

“The trial is over and there’s no chance that Judge Merchan is going to vacate the verdict and grant a retrial,” Shu told Fox News Digital. “Both the verdict and the gag order now will go through the New York state appellate system as two separate appeals.”

Shu noted that Trump’s lawyers filed an expedited appeal of the gag order and that typically “anytime a litigant asks the highest court in a jurisdiction to step in and shortcut the process, it has to be something very unusual for them to agree.”

Steven Cheung, Trump campaign spokesperson, said in a statement, “President Trump and his legal team will continue to fight against the unconstitutional Gag Order imposed by Justice Merchan.”

“The Gag Order wrongfully silences the leading candidate for President of the United States, President Trump, at the height of his campaign. The Gag Order applies only to President Trump and not to any of his political opponents, critics, or even Crooked Joe Biden,” Cheung wrote.

“The Election Interfering Gag Order violates the First Amendment rights of President Trump and all American voters, who have a fundamental right to hear his message,” he added.

Fox News Digital reached out to Merchan’s and Bragg’s offices for comment.

United States Rep. Ilhan Omar, in a Tuesday X post, critiqued Senator Marsha Blackburn’s stance that students encouraging or committing acts of terror on behalf of Hamas should be put on both a terrorism watchlist and the US’s No Fly List.

Blackburn posted on X that “any student who has promoted terrorism or engaged in terrorist acts should be immediately added to the terrorist watchlist and placed on the TSA No Fly List.”

In response to the post, Omar wrote, “A sitting senator labels Americans protesting against a foreign country accused of carrying out a genocide funded with our tax dollars as terrorists and puts a target on their back to be attacked. This is insanely dangerous and somehow no one will condemn it.”

Imagine that twerp accusing Israel of Genocide, when the reality is that the pseudo Palestinian Hamas and Hezbollah are responsible for every single death. 

THE ILHAN OMAR CON

Omar was born in Mogadishu, Somalia, in October 1982. According to the biography posted on her own website, she lived there for around eight years before her family fled to a refugee camp in Kenya, moving to the United States four years later, and eventually settling in the Cedar-Riverside neighborhood of Minneapolis in 1997.

In a 2018 interview with the Intercept website’s “Deconstructed” podcast, Omar said she became a naturalized U.S. citizen before she turned 18 years old, explaining that “My father became a citizen and so I got my citizenship through that process.”

In the same interview, she said her family resettled in the U.S. in 1995. Since a would-be naturalized citizen must first live in the U.S. as a permanent resident for five years, 2000 would be the earliest year in which Omar’s father (and Omar herself) could become citizens. Since Omar was born in October 1982, she turned 18 in October 2000. So, based on the sequence of events presented by Omar, it appears she became a U.S. citizen at the age of 17, sometime between January and October 2000 —

Although Omar’s account makes sense, and we found no substantive dispute over it, we were unable to locate any official documentation that supports that version of events. We asked Omar’s spokesperson and district director to provide any official documentation that would confirm the date of her naturalization, but we received no such evidence.

The Congresswoman’s spokesperson reiterated that she became a U.S. citizen in 2000 and pointed out that an individual cannot be elected to the U.S. House of Representatives without demonstrating citizenship, but the spokesperson did not have Omar’s “personal government documents.”

Until and unless evidence of that nature becomes available to us, definitively establishing that Omar became a U.S. citizen in 2000 she has pull off one of the greatest cons in history.

  • 2002 — Took out a marriage license to marry Ahmed Hirsi (AKA Ahmed Aden), but did not marry him except in a Muslim ceremony; they had two kids;
  • 2008 — Parted from Hirsi; a Muslim divorce, not recorded, took place;
  • 2009 — Married Ahmed Elmi; a marriage certificate exists;
  • 2011 — Parted from Elmi, with a Muslim divorce;
  • 2012 — Reunited with Hirsi and had a third child;
  • 2017 — Formally divorced Elmi (after being elected to the legislature);
  • 2018 — Married (re-married?) Hirsi and was nominated for Congress.

At the very least, a busy lady — one with a fondness for guys named Ahmed.

It is outrageous that her father got a job at the post office when so many of our citizens are unemployed. How did that happen? Secondly, she became a professional nutrition educator at the University of Minnesota. No doctorate here. Omar also wrote, “Israel has hypnotized the world, may Allah awaken the people and help them see the evil doings of Israel.

In November 2021, Republican Representative Lauren Boebert said she had shared an elevator with Omar, and that she and a Capitol Police officer both mistook Omar for a terrorist. Boebert referred to Omar as the “Jihad Squad”.  Omar said that she had not shared an elevator with Boebert, that the story was made up, and that Boebert’s comments were “anti-Muslim bigotry”.

Who is Ilhan Omar’s husband?

Omar has been married to Tim Mynett since March 2020.

Mynett, is known as a political consultant whose consulting firm, the E Street Group, received more than $523,000 from Omar’s campaign during the 2020 election cycle.

Omar’s campaign was the E Street Group’s biggest moneymaker.

The connection between Omar’s campaign and Mynett’s consulting firm was brought to national attention by her critics and opponents.

In response to the critics, Omar’s campaign terminated its contract with Mynett’s firm on November 17, 2020, saying the termination was to “make sure that anybody who is supporting our campaign with their time or financial support feels there is no perceived issue with that support.”

The two have also faced rumors that the relationship began as an affair.

Beth Mynett, Tim’s ex-wife, accused the two of having a relationship when she filed for divorce in August 2019.

What happened at Ilhan Omar’s congressional office?

On October 26, 2021, it was reported that there was a suspicious substance found outside her office on Capitol Hill.

While it still remains unclear what the substance was, staff members were told to avoid the area until further notice.

Other offices were seen on the seventh floor of the Longworth House Office Building and were told to shelter in place.

Following an investigation, Capitol Police confirmed that anything hazardous came back negative and the building then reopened.

Has Ilhan Omar been married before?

Throughout her life, the U.S. Representative has been married a total of three times.

Prior to her relationship with Mynett, she was married to Ahmed Hirsi.

The former couple first entered a faith-based marriage in 2002 but then separated in 2008.

After that, Omar then married Ahmed Nur Said Elmi, a British Somali, until they got a faith-based divorce in 2011, when she got back with Hirsi.

Despite a 2011 split, Elmi and Omar did not get a legal divorce until 2017.

In 2018, Omar and Hirsi then got legally married but filed for divorce soon after in 2019, citing an “irretrievable breakdown” of the marriage.

Throughout the course of their on and off again relationship, the couple welcomed three children together, Isra, 18, Adnan and Ilwad.

The awkward moment took place after Biden and his predecessor sat for a 45-minute interview with late-night host Jimmy Kimmel at the Peacock Theater.

As the men stood for applause, Biden’s gaze seemed to become fixed on the crowd for a full 10 seconds until former President Barack Obama took his wrist and led him offstage.

The majority of the Senate Republican conference signed onto the condemnation, including all three contenders for GOP leader in the next Congress, Minority Whip John Thune, R-S.D., and Sens. Rick Scott, R-Fla., and John Cornyn, R-Texas.

Trump was found guilty of 34 counts of falsifying business records by a New York jury last month in a controversial trial, during which he was subject to a gag order.

The lawmakers claimed the former president’s right to due process was violated in the process of his trial. “Even if we disregard Judge Juan Merchan’s financial contributions to Democratic candidates and causes, the prosecutors were permitted to convert alleged time-lapsed business records misdemeanors into felonies because the records violations were supposedly in furtherance of a second crime. Yet, even after the jury rendered its verdict, we do not know what constitutes that specific second crime,” Paul wrote. The Republicans accused the trial of marking “the attempt to imprison a leader of the loyal opposition,” further condemning it for threatening “the existence of due process of law, without which a constitutional republic dedicated to the protection of individual liberty is not possible.”

CONNECTICUT LAWYERS TOLD TO SHUT THE F..K UP

This week, I received emails from Connecticut Bar Association (CBA) members about a message posted by President Maggie Castinado, President-Elect James T. (Tim) Shearin, and Vice President Emily A. Gianquinto warning them about criticizing the prosecutions of former President Donald Trump. The message from the bar leadership is chilling for those lawyers who view cases like the one in Manhattan as a raw political prosecution. While the letter does not outright state that such criticism will be considered unethical conduct, it states that the criticism has “no place in the public discourse” and calls on members to speak publicly in support of the integrity of these legal proceedings.

The statement begins by warning members that “words matter” but then leaves the ramifications for bar members dangling on how it might matter to them. They simply note that some comments will be viewed as “cross[ing] the line from criticism to dangerous rhetoric.”

According to the CBA, it is now considered reckless and unprofessional to make analogies to show trials or to question the integrity of the legal system or the judges in such cases.

For example, criticizing Judge Juan Merchan for refusing to recuse himself from the case is considered beyond the pale. Many lawyers believe that his political contributions to President Biden and his daughter’s major role as a Democratic fundraiser and activist should have prompted Merchan to remove himself (and any appearance of a conflict). I have been more critical of his rulings, which I believe were both biased and wrong.

‘DESTRUCTION OF DUE PROCESS’: RAND PAUL LEADS DOZENS OF SENATORS CONDEMNING TRUMP ‘SHOW TRIAL’ IN NY

Yet, the CBA is warning lawyers that such comments can cross the line. The letter assures members that they are free to criticize, but warns that attacking the ethics of a judge or the motivations behind these cases is dangerous and could spark violence.

I have previously denounced overheated rhetoric and share the concern over how such rage rhetoric can encourage violence. After the verdict, I immediately encouraged people not to yield to their anger, but to trust our legal system. I believe that the verdict in New York may ultimately be overturned. I also noted that I do not blame the jury, but rather the judge and the prosecutors for an unfounded and unfair trial.

Of course, the concern over rage rhetoric runs across our political spectrum. While rarely criticized in the media, we have seen an escalation of reckless rhetoric from the left. For example, Georgetown Law Professor Josh Chafetz declared that “when the mob is right, some (but not all!) more aggressive tactics are justified.”

TRUMP TRIAL WAS ‘ABUSE’ OF THE US JUSTICE SYSTEM

My concern is not with the plea for lawyers to take care that their comments do not encourage such “aggressive tactics.” The problem is the suggestion that lawyers are acting somehow unprofessionally in denouncing what many view as a two-tier system of justice and the politicization of our legal system.

Like many, I believe that the Manhattan case was a flagrant example of such weaponization of the legal system and should be denounced by all lawyers. It is a return, in my view, to the type of political prosecution once common in this country.

For those lawyers who view such prosecutions as political, they are speaking out in defense of what they believe is the essence of blind justice in America. What is “reckless” to the CBA, is righteous to others. Notably, CBA officials did not write to denounce attacks on figures like Bill Barr, or claims that the Justice Department was rigging justice during the Trump years.

Likewise, the letter focuses on critics of the Trump prosecutions and not the continued attacks on conservative jurists like Supreme Court Justice Samuel Alito. It has never published warnings about those calling conservative justices profanities, attacking their religion, or labeling them “partisan hacks” or even other “insurrectionist sympathizers.” Liberal activists have been calling for stopping conservative jurists “by any means necessary.”

In Connecticut, Democratic Sen. Richard Blumenthal has warned conservative justices to rule correctly or face “seismic changes.” That did not appear to worry the bar. Likewise, Senate Majority Leader Chuck Schumer, D-N.Y., also declared in front of the Supreme Court, “I want to tell you, [Justice Neil] Gorsuch, I want to tell you, [Justice Brett] Kavanaugh, you have released the whirlwind, and you will pay the price.”
